Most people arrested for marijuana DUI in Arizona do not know what is about to happen. Here is the sequence:
A separate criminal case is filed in municipal court or Maricopa County Superior Court, depending on the charges.
The prosecution builds its case around blood test results, officer observations, and Drug Recognition Expert (DRE) evaluations.

Marijuana DUI Charges Are Different
Marijuana DUI cases involve legal and scientific questions that do not exist in alcohol DUI cases. Arizona law criminalizes driving with certain drugs or their metabolites in the body — but cannabis impairment cannot be measured the way alcohol impairment can. The prosecution’s case often rests on assumptions that do not hold up under scrutiny.

What the Science Actually Shows
THC can remain detectable in the bloodstream for days or weeks after any impairment has ended. Detectable THC is not proof of impairment at the time of driving.
The Standardized Field Sobriety Tests used at the roadside — the Walk-and-Turn, One-Leg Stand, and HGN — were developed and validated for alcohol. They have not been scientifically validated for marijuana impairment.
Blood test results frequently fail to distinguish between active Delta-9-THC, which is associated with impairment, and inactive 11-Carboxy-THC, which is a metabolite that indicates prior use only.
Jeremy Huss did not learn these weaknesses from a defense manual. He learned them prosecuting the same kinds of cases — and training the officers who conduct these investigations. 13 Years Inside the Arizona Prosecution System
Jeremy Huss was admitted to the Arizona State Bar on October 22, 2002. From 2003 through 2016, he served as an Arizona felony prosecutor handling serious criminal cases involving DUI vehicular crimes, drug offenses, domestic violence, and violent felonies. He tried more than 100 felony jury trials.
During his time as a prosecutor, he also trained Arizona law enforcement officers statewide on DUI investigation procedures, search and seizure law, and interrogations and confessions.
